1. Acceptance of Terms

By downloading, installing, or using parry ("the App" or "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

parry is an AI-powered mobile application that generates message response suggestions. The app uses artificial intelligence to analyze input text and images and provide response options.

3. AI Data Processing and Disclosure

parry uses artificial intelligence (specifically Anthropic's Claude AI) to generate message reply suggestions. When you submit text or images to parry, this content is sent to Anthropic's servers for AI processing. Anthropic retains this data for up to 7 days for safety monitoring purposes, after which it is automatically deleted. Your data is never used to train AI models.

4. Use of the Service

You agree to:

Use the app only for lawful purposes
Not use the app to harass, abuse, or harm others
Not attempt to circumvent security features
Not use the app to generate illegal, harmful, or inappropriate content

5. AI-Generated Content

Responses are generated by AI and may not always be appropriate
You are responsible for reviewing and editing responses before sending
We do not guarantee the accuracy or appropriateness of AI-generated content
You should not rely on AI suggestions for critical communications

User Responsibility

Reply suggestions generated by the Service are created by artificial intelligence and are provided for informational purposes only. You are solely responsible for reviewing, editing, and deciding whether to use any AI-generated suggestion. By sending a message based on an AI suggestion, you assume full responsibility for that message and its consequences.

No Professional Advice

parry does not provide legal, medical, financial, therapeutic, or any other form of professional advice. AI-generated suggestions should not be used as a substitute for professional judgment. If you need professional advice, consult a qualified professional.

Output Non-Uniqueness

AI-generated suggestions are not unique to you. Other users providing similar input may receive the same or substantially similar suggestions. You should not expect exclusivity over any AI-generated content.

6. Subscriptions and Payments

Free tier: Limited daily generations
Pro subscription: Increased daily generation limit and additional features
Subscriptions are billed through Apple App Store or Google Play
Subscription terms are governed by the respective app store
Refunds are handled by the app store according to their policies

7. Cancellation

You may cancel your subscription at any time through:

iOS: Settings > [Your Name] > Subscriptions
Android: Play Store > Subscriptions

Cancellation takes effect at the end of the current billing period.

8. Intellectual Property

The app and its content are owned by parry
AI-generated responses are provided for your personal use
You may not resell or redistribute the app or its outputs

You retain ownership of the text and images you submit to the Service. AI-generated output is not guaranteed to be eligible for copyright protection under applicable law, and we make no representations regarding intellectual property rights in AI-generated content.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your use of the Service at any time by uninstalling the app and, if applicable, canceling your subscription through your app store. Provisions that by their nature should survive termination (including but not limited to intellectual property, disclaimers, indemnification, and limitation of liability) shall survive.

10. Disclaimer of Warranties

The app is provided "as is" without warranties of any kind. We do not guarantee that:

The app will be error-free or uninterrupted
AI responses will be appropriate for all situations
The app will meet your specific requirements

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PARRY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF PARRY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE TOTAL AMOUNT YOU PAID TO PARRY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless parry and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of AI-generated content; (b) your violation of these Terms; or (c) your violation of any rights of a third party.

13. Dispute Resolution

Informal Resolution

Before filing any formal claim, you agree to contact us at support@parryai.app and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If we cannot resolve a dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. Arbitration shall take place in Washington, United States. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver

YOU AND PARRY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS OR REPRESENTATIVE PROCEEDING.

Opt-Out

You may opt out of this arbitration agreement by sending written notice to support@parryai.app within 30 days of first accepting these Terms. If you opt out, the Governing Law and jurisdiction provisions of these Terms will apply.

Small Claims Exception

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the court's jurisdiction.

14. Age Restriction

The Service is intended for users who are at least 13 years of age. By using the Service, you represent and warrant that you are at least 13 years old. If you are under 13, you may not use the Service.

15. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share your information. By using the Service, you agree to the collection and use of information as described in the Privacy Policy, which is incorporated into these Terms by reference.

16. Changes to Terms

We may modify these Terms at any time by posting updated Terms on our website. We will notify you of material changes through the app or by other reasonable means at least 14 days before they take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must stop using the Service.

17. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and parry regarding your use of the Service and supersede all prior agreements and understandings.

18. Governing Law

These terms are governed by the laws of Washington, United States.
